A “serious injury or illness” for covered service members who are not veterans is one that is received while in the line of duty on active duty (or existed before the beginning of active duty and was aggravated by service in the line of duty on active duty) and makes such service members medically unfit to perform the duties of their office, grade, rank, or rating. A “serious illness or injury” for covered service members who are veterans is one that: was received while in the line of duty on active duty (or existed before the beginning of active duty and was aggravated by service in the line of duty on active duty) and manifested itself before or after service members became veterans; rendered service members medically unfit to perform the duties of their office, grade, rank, or rating; qualified veterans for a federal Department of Veterans Affairs Service Related Disability Rating of 50 percent or greater; substantially impaired veterans' ability to secure or follow substantially gainful occupation because of disabilities related to their military service; and became the basis of veterans' enrollment in the federal Department of Veterans Affairs Program of Comprehensive Assistance for Family Caregivers.

1. Because of a qualifying exigency related to the employee’s spouse, child or parent being a military member on covered active duty or called to covered active duty including:

• Short-notice deployment • Military events and related activities

• Childcare and school activities • Financial and legal arrangements • Counseling • Rest and recuperation • Post-deployment activities • Parental care • Other activities as agreed between Employer and employee.

“Covered active duty” or “call to covered active duty” means, in the case of service members of the Regular Armed Forces, duty during deployment to a foreign country. In the case of service members of the Armed Forces reserves, it means duty during deployment to a foreign country under a federal call or order to active duty in support of certain contingency operations. Reserve components of the Armed Forces include the Army National Guard of the United States, Army Reserve, Navy Reserve, Marine Corps Reserve, Air National Guard of the United States, Air Force Reserve, Coast Guard Reserve, and retired members of the Regular Armed Forces or Reserves who are called up in support of certain contingency operations. For the purposes of qualifying exigency leave, a call to covered active duty refers only to federal calls to active duty; state calls to active duty are not covered unless under order of the president according to federal law in support of certain contingency operations. 4. Serious Health Condition Defined The phrase “serious health condition” means an illness, injury, impairment, or physical or mental condition, that involves: 2. Incapacity of more than 3 full calendar days and subsequent treatment or related incapacity that involves.  An in-person visit to a health care provider 2 or more times within 30 days, as determined by the health care provider, provided the first visit to the health care provider occurs within 7 days of the first day of incapacity.  An in-person visit to a health care provider, plus a regimen of continuing treatment (e.g., a course of prescription medication or therapy) under the supervision of a health care provider, 1.
